600+ Pro-Kid Organizations Unite to Make Sure Kids Get the Care They Need

WHY THIS MATTERS: When kids are denied medically necessary care, the consequences can be devastating. In recent years, parents, caregivers, and providers have reported steep increases in coverage denials, often for care that doctors deemed essential. Nearly three in four providers reported an increase in denials between 2022-2024, and over 72% of denials appealed through California’s Independent Medical Review system were overturned, demonstrating how many children miss out on treatment they should never have been denied in the first place. SB 363 aimed to address this systemic problem by requiring insurers to publicly report data on denials, appeals, overturn rates, and related decision practices, bringing transparency to a process that deeply affects children and families.

WHAT MOVEMENT MEMBERS ACCOMPLISHED: More than 600 Children’s Movement organizations signed a statewide letter urging lawmakers to pass SB 363. This strong and unified show of support helped elevate the urgent need for transparency in insurer decision-making and contributed to the bill advancing through the Legislature as a two-year bill, positioning it for continued consideration in 2026.

RE: Support for SB 363 (Wiener) Health Denial Transparency

Dear Chair Wicks,

We, the undersigned organizations, are pleased to SUPPORT SB 363 (Wiener).

For far too long, parents and guardians have had to overcome bureaucratic hurdles to get critical healthcare services for their children, an uphill battle that is time-consuming, confusing, and traumatic. Parents shouldn’t have to fight health plans to get needed care for their kids, especially since the plans have already been paid to provide that care.

That is why we support SB 363, which seeks to revolutionize this system. We aim to hold health insurers accountable for baseless coverage denials and provide the transparency needed to understand why denial rates are on the rise.

Specifically, SB 363 requires health insurers to report to the State of California any denials and modifications made to provider-recommended care. This information will be made publicly available. In addition, the bill mandates fines for those health plans that egregiously deny care. By imposing these fines, SB 363 will incentivize health insurers to make sure that the denials they are making are reasonable and that they are transparent in their actions.

Parents, caregivers and healthcare providers have raised the alarm that treatment denial rates have increased in recent years. Nearly three in four providers reported an increase in denials between 2022-2024. Hospitals reported a 20% increase in private insurance coverage denials from 2022 to 2023. Data from California’s Independent Medical Review (IMR) system shows that these are not good-faith denials—of the denials that are escalated to the IMR process, more than 72% are overturned or reversed, indicating that many people are missing out on recommended, lifesaving care. We know that IMRs represent only the small fraction of denials that are appealed, and it is crucial that we know how often health care is denied but never appealed.

SB 363 will incentivize health insurers to make sure that health care denials are evidence-based and transparently disclosed.

SB 363 ensures that health insurers can no longer operate behind closed doors but must instead provide the care they are obligated to deliver. For these reasons and more, we respectfully urge your vote on SB 363.

WHERE THINGS STAND: SB 363 advanced through the Legislature but ultimately became a two-year bill, meaning it remains active and can continue moving in 2026. While it did not make it to the Governor’s desk this year, the strong response from Movement members and partners significantly increased statewide understanding of insurer denials and helped build momentum for next year’s legislative session. Movement members may have additional opportunities to engage as the bill continues forward in 2026.
